An Operational Works application is required for any prescribed tidal works.
Application – within the resorts
Where the land is private land inundated with Tidal-water and is within an integrated resort, the application and assessment process is as follows:
Within and bounding Sanctuary Cove Resort (SCR)
Within the resort, an application is not required under the Sanctuary Cove Resort Act 1985 (SCRA) however where an application is lodged with Council of the City of Gold Coast it will be processed as prescribed tidal works.
Pursuant to section 104 of SCRA written approval from the chief executive of Department of Local Government, Racing and Multicultural Affairs is required prior to a prior owner within the resort erecting a structure such as a pontoon that extends over the Coomera River. Approval for Prescribed Tidal Works (PTW) is also required from Council under the Planning Act 2016. The process is as follows:
Within and bounding Hope Island Resort (HIR)
Within HIR, an application is not required under the Integrated Resort Development Act 1987 (IRDA) however where an application is lodged with Council it will be processed as a normal prescribed tidal works application.
Approval for prescribed tidal works PTW is required from Council under the Planning Act 2016 prior to the owner of land within HIR erecting a structure such as a pontoon that extends over the Coomera River.
Within and bounding Hope Island flood mitigation channel
An application for prescribed tidal works within the channel will need to have the owner's consent from City’s property section for erecting a structure such as a pontoon that extends over Council owned inundated land.
Single pontoons are only permitted for lots in Palladium Boulevarde and those lots that existed prior to the channel being built. In all other cases a material change of use application for a Marina will be required combined with a reconfiguring a lot application to cover a lease in excess of 10 years and a PTW application for the Marina construction.
Bounding Oyster Cove Resort and Monterey Keys Estate
Approval for prescribed tidal works PTW is required from Council under the Planning Act 2016 prior to the owner of the land within Oyster Cover Resort and Monterey Keys Estate erecting a structure such as a pontoon that extends over Saltwater Creek.
