Information Privacy access application

Requests for access to documents under the Information Privacy Act 2009 (IP Act) exclude documents that are already available via other means.

For example, copies of a rates notice, or your account details are readily available personal documents which can be accessed by you. Before making a formal Information Privacy application, check this website or contact us to find the location of your personal information.

For documents that are not available through other avenues of access, a formal Information Privacy access application needs to be made.

How to apply

To make a formal request to access documents containing your personal information you can either:

  • write a letter to the City's RTI/IP Decision-Maker, or
  • download and complete a Right to Information & Information Privacy Access Application form from the Queensland Government's Right to Information website,

All applications must clearly identify the specific documents requested or provide sufficient information about the documents, to enable the decision-maker to identify the documents being sought.

No application fee or processing charge applies when making an Information Privacy access application.

Evidence of identity

You will need to provide evidence of identity required with your application, or within 10 business days of making the application.

Documents that provide sufficient evidence of identity include:

  • current driver's licence
  • identifying page of a current passport
  • birth certificate
  • copy of prisoner's identity card certified by corrective services
  • statutory declaration of an individual who has known the applicant for at least one year.

This document must be certified by a Justice of the Peace, or a Commissioner for Declarations, or a lawyer or notary public.

If you are applying for access to personal information on someone's behalf, you must also provide a copy of the letter of authority or a notice of engagement. You must also provide certified evidence of your identity.

Personal information amendment application

If the documents provided to you by Council, either through normal access or a Right to Information / Information Privacy application, contain inaccurate, out of date, incomplete or misleading personal information, you may request to have the information amended.

In many cases this can be achieved informally by contacting the City's business unit responsible for the information and providing advice that the information is incorrect. For example, an incorrect address on a rates notice can be changed by notifying Financial Services of the correct details.

Alternatively, you can make a formal request to amend your personal information.

  • what information is incorrect
  • why it is incorrect, and
  • what changes need to be made to correct the information.
