How to access and amend Council information

Members of the public and organisations can request information about Council’s services, activities and operations. You can also apply to amend to your personal information if you believe it is inaccurate, incomplete, out of date or misleading.

We manage these requests in an open and transparent manner, in line with our legal obligations including under the Right to Information Act 2009 and the Information Privacy Act 2009.

Generally, access to Council information may be provided:

  • by administrative access (informal request)
  • through a right to information application (formal request)
  • for a law enforcement activity
  • where permitted or required by law
  • for a subpoena or summons
  • under the Evidence Act
  • through a Notice of Non-Party Disclosure application.

Administrative access scheme (informal request)

Where possible, members of the public may request documents or information held by Council without making a formal application.

Examples of information publicly available or can be requested administratively free of charge:

  • Find property information and search for development applications though PD Online. Documents associated with the applications can also be accessed and downloaded.
  • Make property searches through our Buying and Researching Property page.

Right to information

Right to information applications are formal requests for information in the possession of, or under the control of Council, that are not be publicly available or can be released administratively. They may include documents containing personal or government information.

Before making a formal right to information application, check our website or contact us to find the location of the information you require. For example, minutes of Council meetings are readily available public documents that can be accessed by the community.

Documents released under right to information can be inspected as original documents or copies. Indicate your preference in your application.

You can arrange to inspect documents in a private reading room in our Waterside East office at Holden Place, Bundall.

How to apply

Complete the following form. Fees may apply. You will need to :

  • supply details help identify documents
  • provide evidence of identify if you are applying for personal information
  • provide a letter of authorisation if you applying for personal information on behalf of another person
  • evidence of financial hardship if you are claiming a fee waiver.

Fees and charges

No application fee is payable for access to documents that solely relate to your personal information. However, if the documents are not solely related to your personal information, an application fee applies. The fee is currently $55.75.

There is no charge if the application takes under 5 hours to process. If the application takes longer than 5 hours to process, the charge will be $8.65 per 15 minutes of the time spent working on the application, including the first 5 hours.

There are no processing charges for applications for personal information.

Timelines

We have 25 business days from the date a compliant application is received to provide a decision on access.

This timeline can be subject to extension, depending on the requirements of the application. For example, when a third-party consultation is required, a further 10 business days is added to the processing time.

We will let you know if an application is outside the scope of the Right to Information Act 2009 or if the application does not meet all the requirements of a valid application as soon as practical. We will also provide advice for making a compliant application.

Right to information exemptions

Access to some documents may not be available. This is due to the exemptions and public interest tests provided within the legislation.

Examples of matters which may restrict the release of a document include:

  • information subject to legal professional privilege
  • information that could endanger a person's safety
  • disclosure of the personal information of another individual
  • disclosure of information that could affect confidential communications such as complainant details
  • information that could disclose the trade secrets of an agency or another person.

Amending personal information

If you believe that your personal information held by Council is inaccurate, out of date, incomplete or misleading, you may request to have the information amended.

First, requests to amend personal information may be made to the business unit that holds the information. For example, an incorrect address on a rates notice can be amended by contacting Revenue Services.

You may also seek to make a formal request to amend your information by contacting the Information Access team.

How to apply

To make an information amendment application, you will be required to:

  • state what information is incorrect
  • why it is incorrect
  • what changes are required to correct the information
  • provide relevant evidence (if required)
  • provide a certified copy of identification (within 10 days of making the application).

Evidence of identity

You will need to provide evidence of identity required with your application, or within 10 business days of making your application.

Provide one of the following documents as evidence of identity:

  • current driver licence
  • identifying page of a current passport
  • birth certificate
  • copy of prisoner's identity card certified by corrective services
  • statutory declaration of an individual who has known the applicant for at least one year.

This document must be certified by a Justice of the Peace, Commissioner for Declarations, lawyer or notary public.

Law enforcement

If you are a law enforcement body such as Queensland Police Service, complete the following form. The form will guide you in providing all the details we need to process the request.

Release of information authorised or required by law

If you are an officer of a government agency and you operate under a law which authorises or requires the release of documents containing personal information, please complete the following form.

Subpoena or summons

A subpoena is a document issued by a court in civil proceedings, that says someone must appear in court or give certain documents to the court.

A summons is a court document used in criminal proceedings that instructs a person to give evidence or produce a document to the court.

If you have correctly served a subpoena or a summons on Council, the documents will be provided to the court by the Information Access team.

Evidence Act applications

If you are a party to civil proceedings, you may apply under section 134A of the Evidence Act 1977 to inspect relevant documents.

Notice of non-party disclosure

If you are involved in civil proceedings, you may issue a 'Notice of non-party disclosure' to someone who is not involved in the proceedings.
