Food Safety Standard 3.2.2A

Australia has a new Food Safety Standard to enhance food safety measures in relation to the sale of food.

From 8 December 2023, new requirements exist for food businesses that prepare and serve food. Requirements differ depending on your type of business.

What category applies to my business?

Category 1 – Businesses that make and serve unpackaged food

Examples may include:

  • restaurants
  • cafés
  • fast food outlets
  • bakeries
  • supermarkets that cook hot food (such as cooked chicken and roast meats)
  • food stalls
  • mobile food vans
  • hotels
  • caterers
  • aged care facilities
  • childcare centres that prepare meals
  • fund raising activities that currently meet the licensing requirements under the Food Act 2006.

Category 1 requirements

As a Category 1 business, all three food safety management tools apply.

New food safety supervisor requirements
  • Each business must have a qualified food safety supervisor who is available to supervise the safe handling of food at the premises.
  • Training must be undertaken through a registered training organisation.
  • The training certificate with the appropriate competency code must have been issued within the past 5 years.

Food safety training for all food handlers

All food handlers will need to complete food handler training or show that they have the necessary skills and knowledge in food safety.

Showing that food is safe (evidence tools)

If non-compliances are found at your food business in relation to temperature control and/or cleaning you may be required to:

  • develop standard operating procedures
  • keep temperature records
  • keep cleaning and sanitising records.

Category 2 – Businesses that sell ready-to-eat food that is unpackaged and not made by the business

Examples may include:

  • service stations
  • convenience stores
  • childcare centre that does not prepare meals and only slices fruit brought in by the children
  • delicatessens that do not make or process food but weigh or repackage items for retail sale.

Category 2 requirements

As a category 2 business, the following food safety management tools apply:

  • Each business must have a qualified food safety supervisor who is reasonably available to supervise the safe handling of food at the premises
  • Training must be undertaken through a registered training organisation
  • The training certificate with the appropriate competency code must have been issued within the past 5 years
  • Food safety training for all food handlers
