Sale of land for overdue rates

Council may sell land when rates and charges have remained unpaid for longer than the period allowed under Section 140(1)(c) of the Local Government Regulation 2012.

Council must give a copy of the notice of intention to sell and, where required, a copy of the auction notice to all interested parties, including the owner of the land.

In some cases, Council cannot confirm the owner's current address despite making reasonable efforts to contact them. In these circumstances, Council may provide notices through substituted service under section 239 of the Local Government Act 2009 (QLD).

Auction process

Council will set a reserve price for each property in accordance with the Local Government Regulation 2012.

Council cannot provide further information about individual properties. Anyone interested in bidding should make their own enquiries before attending the auction.

If you are the successful online bidder, you must:

• pay a deposit of $5000 by electronic funds transfer (EFT) to Council’s nominated stakeholderimmediately upon signing the contract of sale
• provide proof of payment to Council’s nominated stakeholder by 4pm AEST on the day of the auction
• ensure the deposit is received as cleared funds by Council’s nominated stakeholder no later than 10:30am AEST on the day after the auction.

The successful online auction bidder is responsible for seeking and securing vacant possession after the settlement of the sale of the property. The list of properties proceeding to auction are listed on this page, along with the full terms and conditions.
