Sale of land procedure

Council has resolved to sell land because overdue rates and charges have remained unpaid for a period longer than the period allowed under Section 140(1)(c) of the Local Government Regulation 2012.

Council must give a copy of the notice of intention to sell and, at the appropriate time, a copy of the auction notice, to all interested parties, including the owner of the land.

Council is giving a copy of the notice of intention to sell and, in the appropriate circumstances, a copy of the auction notice, to owners of the land described in the Schedule below by way of substituted service under Section 239 of the Local Government Act 2009 (QLD) because despite making reasonable enquiries and attempts to serve the notice on the owner, Council does not know, or is uncertain about, the owner's current address.

Auction process

A reserve price will be placed on the land in accordance with the Local Government Regulation 2012.

Council is unable to provide any further information regarding the individual properties. It is the responsibility of interested parties to perform their own enquiries before attending the auction.

The successful online auction bidder must pay a deposit of $5000 to Council’s nominated stakeholder by electronic funds (EFT) transfer immediately upon the execution of the contract of sale of the relevant land. Proof of the transfer must be provided to Council’s nominated stakeholder by no later than 4:00pm AEST on the day of the auction. Transferred deposit funds must be received in cleared funds by Council’s nominated stakeholder no later than 10:30am AEST on the day following the auction.

The successful online auction bidder is responsible for seeking and securing vacant possession after the settlement of the sale of the property. The list of properties proceeding to auction are listed on this page, along with the full terms and conditions.
