Council of the City of Gold Coast Charges Resolution

The Council of the City of Gold Coast Charges Resolution (Charges Resolution) is the City’s current infrastructure charging regime and applies to developments approved in the City from 1 July 2015. Although the Charges Resolution is not part of the planning scheme, it is attached to it. Its purpose is to set out how and when infrastructure charges will be applied to development within the City. It also provides required sections dealing with:

  • criteria for deciding conversion applications
  • methodology for valuing trunk infrastructure for offsets and refunds
  • details of applicable credits.

The most recently adopted version of the Charges Resolution is known as 'No. 1 of 2019', and replaces the existing Council of the City of Gold Coast Charges Resolution (No. 1) of 2018. Its effective date is 1 August 2019 and will be relevant for developments approved from that date forward.

The Charges Resolution sets charges for development within the City of Gold Coast local government area. Changes to the Charges Resolution have been made to:

  1. align with the Planning Act 2016, and
  2. align the maximum adopted charge rates with the maximum adopted charge rates set out in the Planning Regulation 2017.

The creation of the Charges Resolution was a requirement of legislative changes arising from the Sustainable Planning (Infrastructure Charges) and Other Legislation Amendment Bill 2014 (SPICOLA). The Charges Resolution supersedes the Adopted Infrastructure Charges Resolution v1.4 as the framework for infrastructure charging within the City of Gold Coast.

Since then, Council has resolved to amend the Charges Resolution on a number of occasions, as listed below.
